The Court held that s 7(5) prevents orders for security for costs but does not remove the Court's jurisdiction to award costs in habeas corpus proceedings; s 14(4) confers a broad discretionary power to award or refuse costs. Applying that discretion, having regard to the unsuccessful and inappropriate nature of the habeas application, prior related proceedings, the without-notice filing and the burden on the respondent, an award of costs of $800 against the applicants was justified and proportionate.
