The Court found the deceased breached his moral duty to Lindsay because Lindsay performed significant personal and farm labour over many years, often at personal sacrifice, and received only modest inter vivos gifts and loans and an inadequate $5,000 bequest; the proper remedy was to increase Lindsay's provision to 16% of the estate, to be paid in cash (minimum $400,000).
