The Limitation Act did not bar ACC from recovering the overpayment because deduction of the debt from future payments is not an "action" under s2 Limitation Act; on the merits the appellant failed to prove he received the overpayments in good faith and failed to show he altered his position such that repayment would be inequitable under s251(2), therefore the Review Officer’s decision to require repayment was upheld.
