Raukawa was entitled to costs because it was the successful party in the judicial review which quashed the Tribunal decision; although Wairarapa Moana stood to benefit commercially from exclusion and acted reasonably as sole contradictor, the public interest element and its role justify a 40% discount to standard Category 2B two-day costs, which should be paid by Wairarapa Moana to Raukawa.
