    Kruidenier v Accident Compensation Corporation

    Citation
    [2004] NZACC 345
    Court
    District Court

On the balance of probabilities the Court found that the neuropsychological results combined with the credible, consistent history of intense and prolonged workplace solvent exposure established that the appellant suffered chronic solvent neurotoxicity (Type 2 OSN) caused by a work-related gradual process and that the employment environment possessed a particular property or characteristic causing or contributing to the injury, warranting quashing of the Review decision and remitting remaining statutory questions to the Corporation.
