The 1998 Act does not preclude payment of attendant care for periods prior to the date of claim or application; attendant care may be paid retrospectively subject to the assessment criteria in Schedule 3. The earliest general date for payment is the date of injury; for injuries occurring before the 1998 Act commencement and where no prior claim existed the appellant is deemed injured on commencement (1 July 1999) and that is the earliest date for her entitlements.
