DOUGLAS ROY ANDREWS v R [2021] NZSC 32
- Citation
- [2021] NZSC 32
- Court
- Supreme Court
Leave to appeal was refused because the proposed grounds required re-litigation of factual assessments by the Court of Appeal rather than raising questions of general or public importance and there was no appearance of a miscarriage of justice: s 44 exclusion, exclusion of expert evidence and the representative-charge error were correctly assessed on the facts and sentencing adjustment by the Court of Appeal was lawful under established principles (including R v AM).
