The applicant had no existing legal 'position' to preserve because no favourable decision had been made and statutory bars limited review; therefore interim relief under s15 JR Procedure Act was not 'reasonably necessary' and the interim application was dismissed.

The application was struck out because it failed to comply with mandatory statutory requirements (did not identify an applicant group of the type authorised by the Act nor describe the specific coastal areas as required by ss101 and 103), the final amended application introduced essentially different new causes of action after the statutory deadline and was filed for an improper protective purpose to circumvent s100(2), constituting an abuse of process; strike-out under HCR 15.1 and s107 of the Act was therefore justified.

Appellants have standing; statutory vesting under s14 (and successors) applies only to stretches of river that were navigable in fact (i.e. susceptible of use 'for the purposes of navigation' assessed by width/depth and practical capacity to serve as highway in that stretch), not to an assessment 'of the river as a whole'; on the evidence the Waikato River adjoining the Pouakani blocks was not navigable in 1903 and therefore the bed did not vest in the Crown under s14/s261/s354.
