The respondent correctly declined cover because there was insufficient evidence that a Schedule 3 criminal act occurred and the appellant refused the reasonable requirement of a specialist psychiatric or psychological assessment necessary to establish a mental injury under s21; therefore cover could not be granted absent such assessment.
