POULTER v MINISTER OF IMMIGRATION [2013] NZHC 3287

The Court dismissed the review: the Tribunal correctly identified exceptional humanitarian circumstances but lawfully and reasonably concluded those circumstances did not make deportation unjust or unduly harsh given the gravity and prolonged breach of trust in the offending and the unresolved risk of reoffending; the Tribunal did not err in principle or misapply the public interest test and its weighing of factors was within permissible bounds.
