Gray v Accident Rehabilitation and Compensation Insurance Corporation
- Citation
- [1999] NZACC 143
- Court
- District Court
The appellant failed to discharge the evidential burden to show she was incapacitated by reason of her accident at the time she resigned; contemporaneous medical evidence (Dr Boyd's 30 May 1996 certificate of fitness for light full‑time work), her return to work, employer adherence to medical restrictions, and resignation reasons relating to rostering established that cessation was not caused by incapacity, therefore no entitlement to weekly compensation under s37A.
