Clear White did not establish a reasonably arguable present beneficial interest in the property; while arguable equitable claims (constructive trust, estoppel, CCFA relief) may support restitutionary or monetary remedies, they do not support recognition of a current proprietary interest in the land for caveat purposes, so the caveat must lapse.
