Children's welfare and psychological evidence dictated the outcome: limited, gradual cultural contact ordered by the 'soft' toolbox approach; the Court found sufficient evidence of deceptive, abusive and dishonest litigation conduct by the biological mother (and involvement of the father) to satisfy s141 threshold in her case and accordingly restricted her right to commence COCA proceedings without leave; s141 was declined for the father; recusal refused; guardianship and parenting orders made to secure stability for the children.
