The prosecution failed to prove beyond reasonable doubt that the monies were 'party donations' within the Electoral Act such that the party secretary had a superior statutory entitlement; consequently retention or control by the defendants was not proved to be against a better claim and the essential elements of obtaining/retaining by deception (including causative deception and absence of claim of right) were not established; defendants therefore acquitted.
