Permission to commence by originating application was justified under r19.5 and r27.45. Applying s139 of the Trusts Act 2019 and the Court's inherent jurisdiction, the Court concluded the s139(2) factors were satisfied (modest amount relative to duties, complexity, trustee skill, exposure to liability, significant trust assets and revenue, unanimous support, no misconduct) and therefore $10,000 per annum (plus GST, if any) payable to the Chairperson is just and reasonable; retrospective payments from June 2019 to the date of application are approved.
