A PCC has jurisdiction under s71(1)(b)(v) to recommend training, mentoring or counselling even if it determines the complaint lacks established breaches of ethical duties or the Code of Conduct because those measures are remedial and within the broad investigatory and recommendatory role conferred on PCCs; procedural fairness requirements must be observed; leave to appeal to the High Court under s96 required and was properly granted under CPA s303 but the substantive appeal fails.
