The appeal was utterly meritless and pursued in part to delay payment of outstanding fees; accordingly the Court increased scale costs by 50% and awarded costs to the respondent (the barrister) of $16,311.75, noting the sham allegation was gratuitous and potentially harmful but did not materially increase appeal costs.
