Because the appellant obtained and requested a finding of continuous incapacity from 22 February 1993 (based on the 1991 injury), the law (s.40 1992 Act and cl.48 First Schedule 2001 Act) requires weekly compensation to be calculated by reference to his pre-1993 earnings; therefore the review and ACC calculations were correct and the appeal is dismissed.
