The Associate Judge's costs order was set aside because he failed to take into account a relevant consideration — that the judgment creditor did not have notice of the debtor's application to set aside the District Court judgment when it sought and served the bankruptcy notice; on rehearing the discretion was exercised to order that neither party be awarded costs in respect of the bankruptcy notice, the application to set it aside, or the review.
