The court held the need for surgery was not caused by the covered April 2013 injury but by pre-existing degenerative changes that became symptomatic after the accident, so funding was correctly declined; however the reviewer erred in refusing costs because the review was reasonably brought, and reasonable partial costs of review and appeal were ordered.

ACC's decision to refuse the late review applications was correct because the claimant did not file within the statutory three‑month period, ACC had provided notice and application forms, there was no evidence the applications were received earlier or that extenuating circumstances under s135(3) existed, and the claimant did not demonstrate impairment or postal loss affecting her ability to meet the time limit.
