On the whole of the evidence, including temporal factors and the preponderance of orthopaedic and neuropsychiatric opinion, the Court concluded on the balance of probabilities that the appellant's chronic pain syndrome and disabling consequences are substantially caused by the 6 August 1990 accident; accordingly ACC's suspension decision was unjustified and is quashed.
