The Court held it lacked jurisdiction to make the primary implementation decision regarding provision/specification of an automatic vehicle; it allowed the appeal to the extent of confirming the 10 June 2009 letter was a decision giving rise to a deemed decision in favour of Mr Gibson and remitted the matter to the Corporation to implement the deemed decision; this follows s161 limits, the Corporation's expertise, and established principle that primary social rehabilitation decisions rest with the Corporation.
