No arguable question of law was established; Judge Powell applied the Bartels test correctly and his factual findings were supported by evidence, the Complex Personal Injury Regulations were not applicable on the facts, ACC is constrained by the two-stage assessor/decision framework and cannot lawfully increase assessed needs beyond that framework, and the remittal issue did not arise on the face of the District Court judgment; accordingly leave to appeal was dismissed.
