The District Court held the Corporation properly exercised its statutory reassessment power under s84(3); s65 revision did not apply; the percentage figure above the statutory threshold is relevant to entitlement and compensation rather than to the existence of cover; accordingly no question of law arises to justify leave to appeal to the High Court.

The Court held that the first part of ACC's 11 December 2003 letter (the determination that the 2001 Act applied) was a reviewable decision because it settled an unresolved legal position and affected entitlements; the review decision of 30 December 2004 is quashed insofar as it failed to recognise that part as reviewable, but otherwise the review decision is confirmed and the Corporation's substantive determination that the 2001 Act applied is confirmed as correct.

The 18 March 2013 letter was confirmation of ACC's earlier decision and did not constitute a new decision; Dr Brick's report did not present new medical evidence raising a new question such that s65 revision or a fresh reviewable decision was required; therefore there were no review rights and the appeal was dismissed.
