The Court concluded that, balancing Orlov's right to choose counsel against the risk to the integrity and objectivity of the proceedings, the existence of overlapping disciplinary charges against Deliu arising from the same events created sufficient risk to justify debarment; accordingly Deliu was removed as counsel, an amicus curiae was appointed (with option for Orlov to instruct that person), and costs awarded to the applicant on a category 2B basis but not payable immediately.
