On the balance of probabilities, having considered the temporal connection, the perioperative delirium and the weight of specialist opinion, the Court concluded the cognitive impairment was caused by an embolic/ischaemic phenomenon attributable to the cardiac surgery and was not substantially or wholly due to underlying small vessel disease; therefore the injury qualified as a treatment injury under s32 and cover must be granted.
