Updated medical evidence established significant deterioration in mother's health and median life expectancy of two years and that relocation to Te Puke, with live-in support by proposed caregivers, would materially improve her ability to provide day-to-day care for the child; that benefit to the child's welfare outweighed potential adverse impact on paternal access at this time; Family Court erred by effectively imposing an onus on the mother and elevating contact preservation to a presumption; relocation allowed on or after 23 January 2007 and father's cross-appeal on access dismissed.
