Leave to appeal was declined because the appellant did not establish a realistic prospect of miscarriage of justice: the trial judge's findings that digital penetration occurred were supported by the evidence and credibility findings; an appeal would not affect extradition eligibility and was effectively moot as the sentence had been served.
