The applicant failed to establish an arguable beneficial interest in the property held by the son; the evidence showed the father funded and took title, the applicant acted as agent, there was no completed gift or written express trust and subsequent transactions created secured liabilities that negate any equitable interest; consequently the notice of claim could not be sustained and must lapse.
