The notice of claim under s 42 was dismissed because the claimant and registered proprietor were not in a qualifying relationship under the Property (Relationships) Act; however the caveat was ordered not to lapse because the claimant established a reasonably arguable case that S holds the Riverhead Road property on resulting trust and the caveat, supported by affidavits and related proceedings, was not so defective as to warrant lapsing in summary proceedings.
