On the balance of probabilities the judge accepted the treating orthopaedic surgeon's clear opinion and the appellant's credible history of a forceful, prolonged wood‑splitting episode as sufficient to establish a discrete rotator cuff injury caused by the accident; therefore the s 26 exclusion did not apply and the appeal was allowed.
