The Court declined to appoint interim liquidators because the applicant did not establish sufficient urgency or necessity: there was a bona fide dispute over ownership of the software, no evidence the software would be destroyed or dissipated imminently, developer shareholders appear to be major creditors and oppose appointment, security interests exist, and a six-week delay to the substantive hearing was unlikely to appreciably prejudice the value or protection of the assets; therefore issues should be resolved at the substantive hearing rather than by interim appointment.
