On the balance of probabilities the Court was satisfied that the claimant, given her qualifications, experience and repeated contract renewals and the employer's statement that her fixed term would likely have been extended to 20 December 2013, would have obtained continuous personal employment of more than 12 months from the date her incapacity commenced; accordingly s 42(7) is satisfied and the appeal is allowed.
