Because the affidavit evidence established a clear nexus between the offending and the seized assets and the affected respondents did not oppose the application, the Court was satisfied on the balance of probabilities that the assets were tainted and that forfeiture was consistent with ss50 and 95 of the Criminal Proceeds (Recovery) Act 2009; forfeiture orders were granted accordingly.
