Leave to appeal was refused for the questions premised on factual scenarios contrary to this Court's findings (the request was a single request including urgency, and recipient agencies did hold some requested information); however, leave was granted limited to a redrafted legal question concerning whether s 39(b)(ii) permits transfer where the recipient cannot sensibly assess an urgency claim but the transferee agency is the only one able to do so, because that discrete legal issue may be of broader application and was treated inconsistently below.
