On the balance of probabilities the medical evidence favoured the respondent: the 1984 accident effects have long since healed and the appellant's present incapacity is wholly or substantially due to pre-existing and progressive degenerative spinal disease; therefore s.10 excludes cover for the current condition and the Review Officer's cancellation of entitlements under s.73 is upheld.
