Gallagher v Accident Rehabilitation and Compensation Insurance Corporation

- District Court
The Review Officer and Court were correct to treat the 1975 claim as a late lodgement because there is insufficient evidence that a claim was filed in 1975, insufficient reliable medical evidence linking any 1975 knee injury to current osteoarthritis, and the 24‑year delay materially prejudiced the Corporation; therefore cover for the knees was rightly declined and the appeal is dismissed.
