The present caveat was in substance the same interest previously claimed and therefore barred by s148; Growes Investments failed to establish a reasonably arguable caveatable interest or to provide a satisfactory explanation for allowing the earlier caveat to lapse; the settlement notice was effective and the vendor was ready, able and willing to settle, so cancellation was valid; accordingly caveat 7566854.1 must lapse.
