Permission to continue the proceeding and interim injunctive relief were refused because Maxim's evidential case was weak and insufficiently specific as to ownership and unpaid elements; prima facie copyright in typographical arrangements and much of the claimed work vested in the publishers or commissioning party; granting relief would disrupt the voluntary administration, prejudice the collective interests of creditors and the proposed DOCA, and would elevate Maxim above other unsecured creditors without realistic prospect of greater recovery.
