The Court found that peaceable re-entry occurred (either on 20 April 2012 or at latest 27 April 2012) so the lessors validly cancelled the lease, and refused relief under s253 because granting relief would infringe intervening third party tenancy rights and cause significant disruption to innocent third parties despite the tenant having paid arrears.
