The Judge found on the evidence that the claimant's shearing work materially contributed to his lumbar disc pathology (s30(2)(b)) and that the occupational exposure produced a significantly greater risk (s30(2)(c))—a relative risk in the range identified by experts (approx 1.2–1.4) sufficed—therefore cover was payable and the ACC decisions were quashed.
