The court found the excessive scarring was an ordinary consequence of the knee replacement when the appellant's underlying tendency to form excessive scar tissue and osteoarthritis are taken into account; alternatively the injury was substantially caused by the underlying health condition and therefore excluded by s32(2)(a); accordingly the appeal is dismissed.
