Interim relief was declined because applicants did not establish that deferral of the submissions close date was necessary to preserve their position: the substantive relief would not be rendered unavailable by proceeding, the applicants had delayed seeking urgent relief, a large number of submissions had already been made and further prejudice to public and innocent third parties and undue cost and disruption to the statutory timetable would follow, and the underlying judicial review claim was not obviously strong on the limited materials before the Court.
