On the balance of probabilities the appellant's incapacity commenced on 14 June 1997; there is insufficient hard medical or contemporaneous evidence to establish incapacity from 12 June 1996 and no verifiable earnings data to justify assessing reasonable remuneration on the 1996 tax return, therefore the respondent correctly assessed weekly compensation as the statutory minimum under s43 of the 1992 Act.
