Costs were awarded to the successful respondent because costs follow the event; respondent was entitled to category 2B scale costs for 5.85 days ($13,981.50) plus reasonable disbursements ($255.88). An uplift of 30% was justified under r14.6(3)(b)(ii) because the applicant pursued meritless and unnecessary steps that increased time and expense, but full 50% uplift was reduced because the interest jurisdiction issue, while unsuccessful, was not wholly hopeless. The court awarded costs on the costs application ($4,780) for unnecessary additional memoranda by the applicant.
