The Court held the Health and Disability Commissioner is not a "judicial authority" for the purposes of s 7(1)(e)(v) of the Legal Services Act 2000 and, on the facts, the HDC mediation lacked a sufficient nexus to proceedings of a type within s 7 to permit legal aid under the alternative grounds; appeal allowed and LARP's grant of legal aid reversed.
