Judge found ACC did not have a sufficient evidential basis on 22 December 2009 to be 'not satisfied' that the appellant's depression was no longer causally linked to the covered injury; the causal nexus established at onset had not been shown to have been broken by subsequent degeneration, therefore suspension under s117 was unlawful and the appeal was allowed.
