The Court ordered Investacorp to reimburse Mr Thompson $203,457.92 under s166 because defendants failed to discharge the onus of proving it would be unjust or inequitable for the company to bear the reasonable costs; s166 is not limited to the leave stage; Mr Thompson was justified in bringing the claims and the financial benefit to the company supported reimbursement.
