The High Court held the Environment Court did not err in law in awarding near indemnity costs because Central Plains' withdrawal of the designation after critical Commissioner findings and the consequent unnecessary, wasted costs incurred by the respondents made a near-indemnity award reasonable and just; however real estate agent fees for the sale of one lot were not properly payable by Central Plains and must be excluded.
