Although the appellant received the payment in good faith and altered her position in reliance on assurances and accompanying material, the payment was expressly conditional and the appellant later authorised company accounts electing to treat receipts as capital (thereby denying earner status); balancing the equities, it was not inequitable to require repayment under s251, so the appeal is dismissed.
